    Objection date come and gone

    Our date for objections was yesterday June 27 and we had not heard from any of the creditors. Now do I just wait for the disharge? Is towards the end now?

    Wooo- Hooo.. lol.. you can breathe now. it's pretty much a done deal! You should be receiving your paperwork soon, it depends on how backed up the cases are..

      Great. I cant wait to get my papers. Now they cant change the objection due date can they before my discharge? I thought I read somewhere where someones objection date got changed like a day or two after the orginial date.

        I'm pretty sure that any filings for a request to extend deadlines (from the US TRUSTEE, for instance) has to be done before the final date of objections to discharge. If a creditor misses the deadline, well.. they'd better be able to show SUBSTANTIAL cause in order to be successful.. it's highly ulikely. I've heard of people suffering a request to extend a day or two BEFORE the discharge date (OMG!) but, never after. I could be wrong. And of course, the trustee can still reopen a case for a year after it closes, but, if yours was a run of the mill BK.. I wouldn't sweat it. You'll prolly never hear from them again unless you come into an inheritance or win a lawsuit within 180 days of filing. Time to move ahead with your life, my friend, I'm right behind you- with less than a month to go.

            I am in the same boat; a nervous wreck. Our discharge date is 7/1/05. I have not checked Pacer because I dont need anything else to make me more nervous than I already am. We have not heard anything either; I get hyper when I get home from work afraid our attorney will call saying the Trustee wants us to convert to a 13. I will relax if Friday comes and goes. How often does a Trustee object after the 60 days?

              From what I read and am told Im pretty sure once the objection comes and goes we are good. Just have to wait for the discharge papers. Which takes betweens days and weeks. My friend just got hers on June 24 and her date was June 6 but then I see others were discharged within days of the date. I think it depends on the case and how backed up the courts are.

                Thanks. I got paranoid because a guy on another forum didnt find out until a few weeks before his discharge that the U.S. Trustee wanted him to convert to a 13. There was also another person who said he passed muster with the BK Trustee about filing a Chapter 7 but the U.S. Trustee overruled him and told him he had to convert mainly due to inflated monthly expenses. He said he could back them up and the lawyer was surprised but told him he had no choice but to go along with the U.S. Trustee. This too happened after the so called 30 day objection period for the trustee. I realize these cases are not the norm and the trustee can pretty much do what he/she wants but it is still unnerving. Our attorney is not a rah-rah kind of guy and in fact he tends to lean more on the side of holding your breath and keep your fingers crossed kind of philosophy. Doesnt make me feel warm and fuzzy; that is why this forum is so helpful.

                  I know how you feel. I wont feel reflief until Pacer says discharged and I have the papers in my hands. Everythings been so quiet since my meeting and its gone smoothly and we were discharging A LOT of debt. $116,000.
