    Reaffirmation Question on Condo

    Hello All,

    I recently received my Chapter 7 Discharge. All in all the process went well and I'm glad to have it done and over.

    One thing did happen, however. Apparently Wellsfargo didn't receive our reaffirmation agreements (both 1st and 2nd mortgages) in time and so we didn't actually reaffirm these debts. Of course as long as we make our payments all is good.

    I know that our credit report will suffer since these payments won't show up and will not help rebuild our credit history.

    I'm thinking, however, this may be a little bit of a blessing in disguise? With the way the economy is going, if in the future I can no longer afford the house payments, can I simply walk away since I never reaffirmed these debts and they were technically included in the BK?

    Yes, if the reaffirmation agreement was never filed with the court, then you have not reaffirmed, and therefore, you can walk away from the condo owing nothing, if you so choose.

      That's what I thought since when I look at my credit report both accounts now say:

      "Debt included in or discharged through Bankruptcy Chapter 7, 11, or 12"
