    I am new

    Hi -

    I'm new here - I'm probably going to file C7. I have researched it a lot and today I found this forum (great forum BTW!).

    I'm meeting with an attorney tonight.

    I have never thought I should file but I think I'm finally convinced that the law allows me to (I am under the median for my state) so maybe I should just do it. Right now, by the time I pay bills, I'm left with $200 for gas, etc. I am married and my husband contributes but we pretty much have our finances separate. I have a bunch of CC debt that I really need to free myself of so that I can get out of my snowball effect.

    Yesterday in my research I thought I might use an online service, but I think that might not be the way to go. I'm sure I could do it that way but I think a "real" attorney in my town sounds like a better route for peace of mind.

    I just thought I'd introduce myself and say I'm glad I found the forum! I am sure I will find it helpful in the future.

    Oh, I do have a question - right now all bills are current and always have been. I know that once I decide to do it I will be told that I should probably quit paying the CC's and pay the attorney. How long until the CC companies start calling?

    I think I may go ahead & retain the attorney once I make my final decision so I can tell them that.

    The way you and your husband keep your bills it seem as if you are not married. If you are able to make payments, and you say that all bills are current, why are you considering BK?

      Yeah, the way we do our money does not seem typical.

      The reason I'm considering it is because while I do and can make my payments, I am left with no money - barely enough to buy gas back & forth to work.

      He gives me some money, but not a lot (he's on disability) and even with that, I'm not left with money to buy anything extra. It seems like anything I need that is extra (be it clothes, any emergency that would occur on my house, etc.) it ends up back on the cards.

      I feel like if I could eliminate the cards, I would be able to put some money in savings and also be able to pay for things that I need.

      Maybe I'm wrong for thinking I should file? I cannot seem to get out of my mess with my current financial state.

        Have you considered what disposable income you have when you total you and your husbands income minus all of your expenses together? You will need to do so in order to find out if you qualify for C7. There is a chance it could go to a 13 if you have a significant amt left over.

          Yep, I did a worksheet I found online and with all of the expenses, it leaves us with not much money left. I think (based on what I've read & researched) that I would definitely qualify for C7.

            From what I hear "they" are very specific about how much is leftover. Is it more than $200? If so that may be enough to go into a 13. I'm not sure, someone else may want to chime in here.

            I hope you qualify for a C7, sounds like you've done your homework.

              I saw the attorney and he said I would qualify. So I gave him $100 to get things moving. I had all of my information so he can get started and file when I pay him the balance.

              I have to do that course online.
