    Whew! Made it through the 341 Meeting!

    I was so nervous I thought I was going to puke. However, my attorney knew the trustee and said this would be "short and painless". And it was - less than 5 minutes later, the trustee said there were no assets and that was it! I was told it will take about 90 days for the discharge to come through, but I'm through the worst so I'm glad about that. Then, my attorney suggested strongly that I sue my prior attorney for malpractice. Apparently, (I was in Chapter 13 originally) I never should have been put into a chapter 13 since my income in within the limits for a chapter 7. So he's looking into this because I'm out about $13,000 because of this inept attorney ($3,000 HIS retainer; over $7,500 for chapter 13 payments I shouldn't have been paying and another $3,000 to hire another attorney).

    But for now, I'm filing a complaint with the Illinois ARDC. Then I'll go from there.

    Just wanted to let those of you who are getting ready to go to your 341, it was a piece of cake. I was all worried and sick to my stomach for nothing!

        Holy cra*, why is it taking so long? Is it because of the location you live in (i.e. LA) or missing papers?

          gophermn, see my disertation at the "holy crappin' crap" thread (now on page 2). We just went through a 2004 examination on Monday. Our protracted battle has nothing to do with location, nor with missing papers.

            It is weird that it takes so long but I figure I see the light at the end of the tunnel (hope its not a freight train LOL). After two years of hell, I can finally breathe. I feel like a weight has lifted off me

              My last day for objections is May 5th. I'm TRYING not to worry about that LOL It's a good club to be in. Reading these posts has really helped alot, not only in information I needed, but it's nice to know I'm not alone in this

                Good luck suing your attorney! I'm convinced that quite a few attorneys should be sued, or at least have complaints filed against them.

                  I never even thought of suing the bum until my attorney said something. He said this was an obvious case of malpractice because if this guy had done his job, I would have been all through with this crap a year ago. I spent months paying money to the trustee I couldn't afford (I kind of got tired of hot dogs and mac & cheese!) and this guy refused to help me no matter how many times I begged him to. I would like to sue him. It's not the money (though that would be nice) - it's the principle of the thing, you know?
