Now reading here, that seems to be bad advice? I hope I don't have a bad attorney. I have it financed thru my local credit union and I'd feel worse not keeping that loan. I could always switch banks I suppose. If I were to do that, maybe I should switch banks now? I kind of hate to give up my car since I like it, but it's a 2002 and I still have 4 years on the loan @ 370/month - eek! I'm guessing you all are going to advise me to turn it in.

I also wonder how I would get a new car if I gave mine back?
Well, credit unions SUCK with BK. We need to put a big banner on the front of this forum, if you are going to file BK, GET OUT OF YOUR CREDIT UNION.

It is ultimately a financial decision, but since you are with a credit union, you may have to reaffirm. Do you have any other debt with this CU, (credit cards, over draft, etc), if yes, then reaffirm.

There is nothing inherently wrong with reaffirming, but at the same time, there is very little, if ever any "benefit" to the debtor for reaffirming. If you want the reaffirmed debt to be reflected on your credit report, the reaffirmation agreement needs include such a provision in its terms.

you mean cu's don't let you discharge?

I don't have anything else with them.

I could get a car before I file (maybe) but I'd be just as upside down as I am now I would imagine. Unless I got a really good deal somewhere. Right now my credit score is 687 which would probably allow me to trade my vehicle in but I think it would defeat the purpose doing it before I file.

If I turned it in, then I'd have to find something quick and probably have a high interest rate.
      Filed C7: 3/21/08
      341 Meeting: 4/23/08
      Objections to discharge due: 6/23/08
      Discharged 6/30/08
