We are suppost to get back $1400 for federal this year, but we owe state $500. What are the odds that the trustee will keep the $1400? We would like to use it to pay state, and get caught up with the utilities and such. We do not have any way to exemt it. We filed $120k in debt, doesnt seem as though $1400 will make and sort of dent.

It depends on the trustee...but legally, if there is no way to exempt the funds, then the BK estate is entitled to all of it regardless of your state tax liability. I suggest you figure out another way to pay your state taxes.
