341 meeting and income

    341 meeting and income

    I passed the test and line up perfectly under the median income for the last 6 months.. I filed on the 11th of this month and my 341 is on april29th.. my question is that do i need to continue to watch how much money i make until the 341 meeting or can i start having big paychecks?

    That kind-of depends, what would cause you to "suddenly" have big pay checks again, and how much more are we talking about here (in terms of percent).

    Generally it does not matter, but because we are talking about income (and not assets), you probably don't want to have too big of an increase.

      well right now they have my income figured out at about $2400 per month but with the summer comming and my paychecks getting bigger it would be nothing to have that $2400 check in a 2 week period or even one week period for that matter

        It probably behooves you not to show a dramatic increase in your income until after the 341. Some trustees will ask you, under oath, if there has been any change in your financial circumstances since you filed your petition, and have the right to ask you for your latest post-petition pay advices, as well as bank statements that include the date of filing. Best to play it safe and stay under the radar at least until your 341 is concluded. It may or may not come back to bite you.

          what is the worst that could happen with that big of an increase? my job is seasonal so i am not sure if they would realize that or just see the income.. The reason i am asking is i am looking down the barrell of a check for $2,800 for 2 weeks when in the last six months i have mad $2500 per month..... any ideas??

            Post-petition changes in income can result in a US Trustee request for dismissal under 707(b)(3)*.             Do you really want to risk it? You'll be swearing under oath as to changes in your financial circumstances since you filed your petion.
