Just looking to see what kind of experiences people had when they had to include unpaid balances on their furniture + electornics (such as Best Buy and your local furniture store such as Harlem, etc). Did you have to return all the stuff back or no ? I didn't include my Best Buy & furniture store as my attorney told me that most likely I would have to return those back. Please share your story if you have experience with this. Thank you.

I got a letter from Best Buy's "lawyers" after discharge asking for their stuff back. They sent me 2 letters and called a few times. I ignored them all and they never bothered me again. It's been 2 years since I was discharged so I don't know if things have changed with Best Buy, but I doubt they have. They really don't want their stuff back, but can come after it if they want to.

Best Buy is more bark then bite. Just ignore them and they will most likely go away.
Same goes with furniture stores, but they can be a tad more aggressive, especially if they are a fairly small, local store. But usually, you can keep the stuff, the stores would rather take the loss than take the items back in inventory.

Yes, you can add them. The amendment procedure is simple.Originally posted by MidwestGuy View PostBut can I still add those things to my BK even though it has been filed ?
Whether they want the items back depends on how recently you made the purchases and how much you spent.
If you bought a $2,500 LCD TV within the last 3 months, yeah, they are probably going to want that back. but if you bought a $700 computer 6 months ago, you can probably keep that.

Computer was bought about 6-8 months ago, $600.
Furniture was bought in November of 2006 for 7k, balance now is 4,500. It was 3k but we didn't pay it off in a one year and they added all the interest on it.March 13, 2008 - Chapter 7 filed.
April 15, 2008 - 341 Meeting.
June 16, 2008 - Deadline for objections
June 20, 2008 - Case closed!

I bought my furniture about 5 months before filing made 2 or 3 payments balance was and most likely still is 6k .. and a ring 300.00 left and a washer and dryer front loader 6 months old 3k and a computer 1 year old 2k ... I ingored everyone F them 21% apr.. They stupid for even thinking anyone would/ could finish paying with a default of 21% anyways I just losted it for a minute.. I ingored all of them 5 separate accounts 3 creditors and I now live 1200 miles away.. they called a few times acting dumb trying to scare me, like the items are worth my freedom from debt my bk ..I just talked to them careless (wouldnt have answer but the one got my off guard.) anyways still have my stuff and they stopped writing and calling .. but their key is to try to scare you so you reaffirm the debt or pay in full or settle. What I did was put it in my mind they would come get it - so if they did I would be ready .. but in my case its a plus they havent.*Filed Chp 7 bk 11/13/07 PRO SE :yahoo::yahoo:[x]

Not only CAN you add them, you MUST add them. You should include ALL debts on your petition, under law, and if you leave any off you run the risk of not having those debts discharged. They may not want your stuff, but they'll still sure try to collect their money, as those debts are not protected by either the automatic stay or any subsequent discharge.Originally posted by MidwestGuy View PostMy BK was filed few days ago, could I still add stuff to it or would it be too late at this point ?

There are some stores that will come after their items. There is a large local store in my city that my attorney told me was known to go in a rip carpet out of houses after a discharge. I bought a computer and washer & dryer 4 months before filing, did not reaffirm, but continue to make the payments and will pay off the balance in a year.
