I'm currently filling out my Ch. 7 paperwork for filing on Thursday and I have a few questions I hope someone can help me with.
1. On the Statement of Financial Affairs, it asks for me to state the amount of income received other than employment. Would student loan money fall under this category? It's never been considered income in the IRS's eyes and I never listed it on any of my tax returns so I wondered if I needed to list it on the Statement of Financial Affairs.
2. I had a pending judgment case against me from one my creditors with whom I agreed on a repayment plan and a consent judgment entry was entered against me. Is this automatically vacated by me filing a bankruptcy or must I file a motion to vacate? If so, how and when would this be done?
3. A few of my delinquent accounts which I'm listing have been transferred or sold to collection agencies and in the case of my one creditor with whom I have a consent judgment entry, a law firm. Who name and address should I list? The collection agency/law firm or the original creditor? Also on this form, is a credit card considered a trade debt? Would it be contingent, unliquidated, disputed or subject to setoff?
4. I'm a little worried about losing my car. It's a lease through VW credit and I have no problem making the payments (always have and never been late), but even if I reaffirm (and I can do this by automatically continuing to pay...I'm in Ohio), is there a possibility that VW would try to repo the car anyway or this unrealistic/impossible for them to do?
