    Jointly titled house question

    I filed Chapter 7 without my husband. He has no debt in his name and we have no joint debt (other than our house).

    We are both on the mortgage of the house. There has been no reaffirmation agreement with Wells Fargo. Could I legally walk away from that house now unscathed? They would come after my husband only then correct? This is if we decide to let the house go or if we ever decide to split up.

    I'm just curious how the creditors handle a situation like this. Does anyone have any experience?
    11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

    You are the one who filed-you would be the one who signed any reaffirmation agreement. If you don't reaffirm you can quit paying with no liability for a deficiency balance. It will all fall on him.

      Wow, that would SUCK for him then huh. I can walk away at any time and no one can touch me.
