    2 questions...

    My first question is... we are reaffirming 2 vehicles, (we are pro se) and our hearing for the reaffirmation is tomorrow. DH & I have 2 young children, and nobody to watch them. I know it is going to be a neusence, but we have no choice. Can we bring them with!?

    Also, our 341 was back on 2/14. Our trustee has not delcared our case an asset, or a no asset case. They have our $1100 tax refund check, so I am assuming that he will declare it an assett case, but I dont want this to delay our discharge that is scheduled to occur in 2 weeks!! Is this time frame normal, or is there going to be trouble?

    Not sure about the answer on the kids questions.

    If you have any available exemptions left, perhaps you could file an amendment to include your tax refund?

    We had a very large refund and were able to protect it that way.

      The hearing to which you are going is held in a court of law. IMHO, that is no place for young children. Think harder, certainly there is someone that owes you a favor. We had our reaff hearing on March 3rd. Ours remained a non-committed "asset/no-asset" case until after the hearing. But I do not know if that was a function of the hearing or more a function of the Rule 2004 examination that took place that same day. (Note: the reaff hearing and the Rule 2004 exam are unrelated. We chose to do them on the same day because of logistics.) By March 5th, pacer was reporting us to be "no asset".

        What about taking the kids and one of you staying in the hall, outside of the courtroom, with them and explaining to the judge that you had no other choice and didn't want to disrespect his court by brining them in.... that way, you can tag team by one being in the courtroom, one out in the hall. The judge may surprise you and just advise you to bring them in, but at least you've given them the choice.

          If they keep your taxes then you are an asset case. While this may delay closing it does not delay discharge (the one that matters to you). As long as all else is well you should discharge on time.
