    new place to live

    Planning to file ch 7 in June and we are letting the house go back to the bank. I know the forslosure process takes a long time but we have been very concerned about finding a new place to live. Looked at a house to rent yesterday and want to take it. My question is, is that o.k. to start renting a new house, in May, when we haven't filed yet and forclosure hasn't started. How will that work out with the bk? Will it raise any questions?

    We did just that! We wanted to get in while our credit was still clean. No issues so far. My lawyer didn't even bat an eye when we told him about it.

      Good to hear. Once you file though, will they report your BK/Forclosure to the landlord? Were you upfront with your BK info when you were in the renting process or what did you tell them?

        We did the same. Filed in Jan '08. Signed rental lease in Dec '07 and moved in Feb '08. I was upfont with my landlord telling him what was going to happen and he had no issues with that. He told me he went through a business bk 8 years ago, so he at least was familiar with bk. We did end up listing him in the bk under Executory Contracts and Unexpired Leases, Schedule G. We signed the lease before we filed.

          That's what we did almost 2 years ago. I knew I couldn't keep the house so we bought a mobile home (which was actually nicer than our old 103 year old house!) The community ran a credit check so we got in just under the wire. I figured I'd better get while the getting was good or end up who knows where!

            We were upfront with property manager about our situation. She was hot to run our credit before it was trashed. I know she recieved a notice of our filing, however nothing else should come her way.

              My question is, what if you plan to let the house go, you find a new place and move in, then your BK doesn't get discharged? I suppose that doesn't happen often, but what if it did? That would suck.

              I'm thinking of letting my house go too and moving and the thought of my bk not getting discharged scares me!
