Has anyone lost their stimulas check yet?

Our attorney listed our stimulus check as an exemption, so I'm pretty sure we're safe...

Ours was listed as an exemption as well BUT we were told not to spend it because at this point attorneys are exempting it with the "hope" that the trustee wouldnt take it. No one knows for sure.

We delayed filing because of this. How could I sit with $1800 in the bank with bills to pay, food to be purchased, car payment? Still havent gotten the stimulus money but I just cannot lose it. All the while just keeping my fingers crossed that someone with alot more money than I decides if he wants more. In my honest opinion these Trustees dont need a dime of this money. Its not going to make any difference after "admistrative fees' to the creditors. I think there will like be a little greed in the minds of the trustees at the opportunity of collecting thousands and thousands from no asset chapter 7's. I guess that would be only human but I still wish at least the amount sent for having children was off limits.

I had my 341 on 5/2/08 and the Trustee made no mention of taking the stimulis check from us. We are getting 1800.00 back. Should get it in mid June.Attorney told us that they were not in fact going after the checks.We are in the Middle District of Florida.Anyone else have a different answer for that district.

Sunshine Mary is in our district too and they took hers so there are some trustees in Middle District of Fl that are taking them.

Indiana...yes, they took our $1800.00 that we intended to use for our savings.

We had our meeting on 04/29 and we are expecting $2100 back. Our lawyer exempted our $1000 tax return. The stimulus was not listed as an asset when we filed in March. Our 341 took 2 minutes, the trustee never mentioned our tax return or stimulus. After our meeting we asked the lawyer if they take the stimulus checks and she looked at me like I had 5 heads and said no, and that we get to keep it. We haven't received it yet, we should get it in June and I hope the trustee won't change his mind, can they?
It says no assets on pacer (trustee added that after our meeting) and awaiting discharge.
We intend to put the money into savings for emergency's.

Middle district of Florida seems to go either way...Our trustee took ours but I didn't hear her mention it to anyone of the 3 cases before ours....I know it's a small price to pay for such a large discharge but I'm still bitter about it and I'm hoping our attorney does something to get it back.

And BTW in one of the cases before ours the man was asked what he did with his income tax refund and he told her and then was told it was property of the bankruptcy estate and needed to be returned. I gave her a list of what we spent ours on and she seemed satisfied so I think it's an individual thing. I couldn't figure her out.

We got our check on 5/2. Our 341 was today - the trustee asked if we got a tax refund, I mentioned the stimulus check, he asked how much, asked if we had kids, and that was it. Our attorney said hold off on spending it for a few days, but it sounds like it's safe *crossing fingers*

Western district NY, he's taking ours. I'm not happy about it, quite livid as a matter of fact, but what can we do? I consider it a pennance of sorts, but man o man could we really have used that money, and momof5 is right, at the end of the day, that money really is a drop in the bucket to the trustee/creditors, I guess he just wants to get that very last dig in while he still can.

Oh well, live and learn I guess.
