    Independent Contractor

    A small part of my income (about $6k) comes from a part-time job, for which I am an independent contractor and receive a 1099 at the end of the year. The way I am paid is that the company sends me a personal check every 2 weeks, and I just deposit it into my bank account. I have had this job for several years now. The only expenses I claim on taxes is mileage on my car and Internet access.

    On my taxes it is filed as self-employment, but I have never bothered to keep any records (ledgers, etc.), since it's not a business in the sense where I have lots of accounts receivables or expenses. For the past couple of months I have been depositing these personal checks individually and keeping the ATM receipts, so that when I file in a few months I can at least have a record of the deposits.

    Previous to that, I would sometimes deposit these checks along with any other checks/cash I wanted to deposit (for example perhaps someone gave us a small cash gift for Xmas, I would deposit that with the check).

    Could the trustee make a stink about the fact that I will only have a few months of ATM deposit receipts? I was thinking about taking photocopies of the checks before I deposit them, but not sure if that is necessary

    One thing I forgot to add...the income from this job is pretty much the same every two weeks (with an occassional increase during the holidays, the job consists of doing computer support on an on-call basis from home, so I am paid per shift...holiday shifts paid a little bit more)

    Well most likely they'll want some sort of record, if you don't get paystubs then copies of the checks should work. It might be possible to contact the main employer and ask for a record of all checks sent to you in the last 6 months. They are bound to keep some kind of record ( I had to go get duplicate check stubs from mine cause I didn't have 6 months worth).

    At least you've been paying taxes on it so that means you shouldn't stir up anymore trouble.

          Me too Otherwise I am not sure how else I could prove it. The amount of this income haven't changed hardly at all over the years so hopefully that will help.

          What could be the worse a trustee could do if I have no other proof?

              I was thinking too, my bank statements will show all of these deposits as well, so I hope that helps

                  I don't know for sure, but I'd think that if they look at your bank statement deposits then they might consider the full deposit amounts (ie:contractor check + gift money) as income. My understanding is for the 6 month look back they want ANY money received during that time span to be listed as income. I'd do what I could to avoid any scrunity of bank statements.

                      I'm an independent contractor too. I get a 1099 each year for my taxes. I have been claiming this income since I started working in this field, 1995, I work with another women who pays me. It is much simpler to have a customer write one check rather then 2 so that is how we have always done it. Basically it was her business before I started working with her anyway. I only claim mileage and a very small amount for clothes and rags that is it. I have a record of all my deposits in our bank acct. I do keep a record of my mileage and so far in the last 6 months I haven't had any other expense. I did a very simple profit/loss statement, which my attorney recommended. Only expense on there for the 6 month period is mileage. My total gross income for 2007 was slightly over $7k. Our attorney isn't worried and I am not going to let myself worry either, well, I am going to try and keep from worrying. We are so far under median for our state, we are hoping it will all go well.
