    Giving up assets to the Trustee. Do they pick them up?

    I forgot to ask my atty. a question yesterday concerning assets I plan to turn over to the Trustee. Does the Trustee arrange to have someone pick them up to be taken to auction or do I have to make arrangements to do it?

    I know this probably varies by District, but some of this stuff is heavy and I don't have the means to move it unless I hire someone or pay a couple of guys and rent a truck which is a pain. Any thoughts?

    I believe the Trustee does that, I don't think you have to do anything more than tell him where it is and if necessary be there to unlock doors so his appointed agents can claim it.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      Thank you so much. I hope you're right because that would be adding insult to injury by forcing me to scramble around trying to pay someone to move that stuff. Thanks again.

        They were right I asked my attorney because we will be in the same boat. I read you already had a offer from your trustee to keep some stuff ?? I think we had our 341's around the same time ( mine was 5/5 ) but I haven't heard anything. I'm jealous haha well you know what I mean I just want to know how much LOL !!!

          Sunshine, I know exactly what you mean. I started to get concerned when I thought about how much stuff I would need to try to move. I'm glad to know that I can give someone access and let them deal with it.

          I was shocked to receive the offer from the Trustee before it actually showed up on PACER. In fact, it still hasn't been updated on PACER. It seems like a have a pretty efficient Trustee because everything has been processed by her office very quickly.

            Assets to Trustee: WHEN?

            What is the typical timing of when the Trustee wants to take posession of non-exempted assets? Is it before, at or after the 341 meeting?

              It must be after the 341 because we had ours already and the attorney said she would come up with some numbers with the trustee. That's our experience anyway.

                I had some business equipment and I was just asked to give the name and location where it was stored at the 341. The trustee hired an auction house who then called me for descritpions of the equipment before he went to view it. What with all the notices being sent and published the sale took place about a month and a half after my 341. According to PACER I could see how much the items sold for, and the auctioner's bill for providng the sale. But after my 341 I never had any direct contact with the stuff again. I'm with you, as long as I didn't have to pay to move or store it I didn't care what happened to it.

                  I had my 341 meeting on 5/6/08 and received the notice from the Trustee on 5/16/08 regarding the amounts I have to pay if I wanted to keep certain items. I was given a deadline of 5/26/08 to respond in writing to agree with her proposal or submit another one for her approval. I agree with halomom, I don't care what they do with it once they pick it up and I'm glad I have pictures of those items to make it easier to identify everything. All I'm waiting for is my discharged status on PACER so be done with this entire thing.
