    Anyone filed ch7 who falls ABOVE median income?

    Hello! I just found this forum today after we have been working with our attorney since Nov. 07 towards filing. At this point we plan to file around 1st of July. My husband makes too much money to safely fit below the median income, but was not able to work overtime since January...so our income is less than before. We have been waiting to show paystubs reflecting his lower salary that we might fit into chapter 7. We still fall above median income..but with "allowed" expenses fall under a little.

    We met with our attorney a few weeks ago to see what chapter we could do and then and he was all peaches in cream about how the 7 will be no prob and it wll be a breezy 15 minute meeting with the trustee. His THEN assistant is no longer with the company and the guy handling our file now is extremely cautious in the fact that we may get a lame trustee that kicks us into a 13...maybe.

    I am sooo frustrated because if we needed to file for ch 13...we could have done that months ago. I just hate to have waited this long and it is not a solid case. Plus...after reading on here I am terrified I didn't keep reciepts or how do I deplete my checking account for day of filing "safely". There is so much....but really I am wondering if anyone has been successful filing chapter 7 when their income was over the median????

    You can pay insurance in advance, you can get house repairs done, dental, food, clothes, medical, etc.

    If you do a search, you will find many posts about members filing C7 that were over the median.

    As for receipts, I hadn't kept any until now. And I am filing next month.

      I am over meadian and filed chapter 7. If you are over you ahave to take the means test. If then you qualify to file chapter 7 it shouldn't be a problem. If you're not sure about your attorney get an opinion from another one.

        We are in the same boat as far as receipts. We didn't keep them until now. I am praying that won't be an issue. We have been waiting to file since Jan. should be filing sometime next month, no later then early July. We seriously thought we would be filed and almost threw it by now, but it's that waiting for this, waiting for that game. And now it's the stimulus to be spent down. So the waiting game I can totally relate to. It's tough, wanting to get it over with, but wanting all your ducks in a row before you do it. I think being prepared, which it sounds like you will be is smart, that's what we are doing.

        I have been lurking on this forum for months now and have seen many successful C7 with income above median. So hopefully you will be one of those.

          I found my attorney end of February, paid him in full in March and have been waiting around until then. Right now I am doing the paperwork(slowly) and spending our checking account down. Hoping to file in a week or 2. I am so ready to be done already.

          We thought we were below median, but come to found out we are slightly above it. We are still able to file C7.
