    Debt Consolidation Vs Bankruptcy

    FILING BANKRUPTCY IS NOT AN EASY CHOICE FOR MOST OF US. I, MYSELF, WOULD HAVE RATHER PAID MY DEBTS, BUT IT DIDN'T WORK THAT WAY. I FILED IN MAY AND AM WAITING FOR DISCHARGE. THIS HAS BEEN A VERY NERVE RACKING YEAR, FLIP FLOPPING AROUND WITH THE DECISION TO FILE OR NOT.
    WENT THE ROUTE OF DEBT CONSOLIDATION. I CAN ONLY SPEAK OF THE COMPANY I DEALT WITH AND IT WAS A RIP OFF. WHEN THEY TELL YOU NOT TO CONTACT YOUR CREDITORS AND TO QUIT PAYING YOUR PAYMENTS. IT IS FOR A REASON, TO PUSH UP YOUR INTEREST RATE, OVER LIMIT AND LATE FEES. WE WERE IN DEBT CONSOLIDATION FOR ALMOST 2 1/2 YEARS OF A 5 YEAR PAYMENT PLAN . TRUST ME WE WERE NOT EVEN CLOSE TO HALF WAY PAID OUT. I NEVER SAW WHERE WERE CREDITED FOR LATE FEES AND OVER LIMIT FEES AS WE WERE TOLD WE WOULD BE FROM THE CREDIT COUNSELORS AFTER 3 CONSECUTIVE ON TIME PAYMENTS. OUR PAYMENTS WERE NEVER LATE. IN FACT, GOT A LETTER WARNING US NOT TO PAY EARLY IF WE WENT BACK TO MAKING THEM ON TIME, WE WOULD TAKE CHANCE THAT BECAUSE OF BILLING IT MIGHT DOUBLE UP OR SKIP A PAYMENT AND THE CONTRACT WOULD BE VOID. WHEN I ASKED FOR A DETAILED LIST OF THE PAYMENTS MADE, WELL I HAVEN'T SEEN IT YET. WE WERE CONSTANTLY GETTING LETTERS AND CALLS FROM CREDITORS THAT OUR PAYMENTS WERE LATE. AFTER CONTACTING THE DEBT CONSOLIDATION COMPANY ABOUT IT WERE TOLD TO CHANGE THE DUE DATES ON THE ACCOUNT (WHAT DID WE CONTRACT THEM TO DO?), WHEN YOU TRIED TO THIS, THERE WAS A SMALL WINDOW OF WHEN YOU WERE ACTUALLY CURRENT AND COULD CHANGE THE DATE, WHICH WE DID. IT WAS SOMETHING ABOUT EVERY OTHER MONTH WITH THIS. THE DEBT CONSOLIDATION COMPANY DIDN'T DO A WHOLE LOT FOR US BY REDUCING THE INTEREST RATE OR THE PAYMENT PLAN (WE PAID OVER A $1100 A MONTH, BY CERTIFIED CHECK, NO LESS).
    WE TRIED TO CONTACT THE INDIVIDUAL COMPANIES AND REQUEST A LOWER INTEREST RATE AND NOT CHARGE ANY MORE ON THOSE ACCOUNTS AND WERE EITHER DENIED OR THE AMOUNT THEY OFFERED WASN'T MUCH OF A HELP. I MUST ALSO ADD THAT THE INTEREST RATE WE HAD ON MOST OF OUR ACCOUNTS WAS BELOW 16% TO BEGIN WITH, BEFORE WE MISSED ANY PAYMENTS AS A RESULT OF THE ADVISE OF THE DEBT CONSOLIDATION COMPANY. AFTER WE QUIT PAYING THEM, THE CREDITORS DID CALL US OFFERING TO LOWER THE LIMIT AND FINALLY "TAKE A PAYOFF" SOME AS MUCH AS HALF. SORRY BY THAT POINT WE HAD NO MONEY.SAVING TO PAY A LAWYER. WOULD PROBALBY STILL BE WITH THE DEBT CONSOLIDATION COMPANY, BUT LIGHTENING HIT OUR HOUSE AND DESTROYED QUITE A BIT OF OUR APPLIANCES. INSURANCE COMPANY WASN'T THE BIGGEST HELP. ALSO THE TIMING ON FAMILY CRISIS WASN'T GOOD EITHER.
    I GUESS IN A NUTSHELL I AM TRYING TO SAY THAT I LEARNED A COUPLE VALUABLE LESSONS. CREDIT AINT WHAT IT IS CRACKED UP TO BE. YOU LEAN ON IT TOO MUCH, ITS TOO EASY TO GET. NO MATTER WHAT KIND OF BUDGET YOU HAVE, SAVINGS DOES NOT HAVE THE PRIORITY IT SHOULD HAVE. BUSINESSES PUSH THE ISSUES-90 DAYS SAME AS CASH-NO INTEREST FOR A YEAR, ETC.
    DON'T KNOW WHAT PRES. BUSH WAS THINKING, PUSHING DEBT CONSOLIDATION, (DOES HE OWN INTEREST IN ANY)BEEN THERE DONE THAT. HOPEFULLY NOT AGAIN.
    BANKRUPTCY IS A PAINFUL CHOICE. TAKE YOUR TIME, DO THE RESEARCH ON YOUR OPTIONS, SHOP AROUND FOR SOUND, GOOD LEGAL ADVISE. THE MONEY YOU SAVE IN THE LONG RUN WILL BE YOUR OWN. I THOUGHT I WOULD HAVE TO FILE CHAPTER 13, DO THE PAYMENT PLAN, LAWYER SAID, I THINK WE CAN DO CHAPTER 7, SHE WAS RIGHT. FILED FOR BANKRUPTCY IN MAY, CAN NOT TELL YOU THE RELIEF IT HAS BEEN TO NOT HAVE THE CREDITORS NOT CALLING OR WRITING. OUR PHONE HARDLY RINGS. WHAT A CHANGE FROM THE CALLS STARTING AS EARLY AS 7:00 AM UNTIL AROUND 10:00 PM DAILY, 7 DAYS A WEEK. OUR MAIL CARRIER'S LOAD HAS BEEN LIGHTENED TREMENDOUSLY.
    MY ADVISE TO ANYONE OUT THERE IN THE SAME SITUATION IS TAKE THE TIME TO EDUCATE AND INVESTIGATE YOUR OPTIONS. TAKE THE TIME TO WEIGH YOUR OPTIONS AND DO A LITTLE INVESTIGATION INTO THE CREDIT COUNSELING COMPANIES AND ATTORNEYS OUT THERE. LOOK AT THESE WEB SITES, GO TO THE LINKS, CALL THE BETTER BUSINESS BUREAUS.
    IT HAS BEEN NOWHERE AS PAINFUL AS I THOUGH IT WOULD BE AND I SLEEP BETTER AT NIGHT AND DON'T CRINGE WHEN THE PHONE RINGS. OUR LAWYER WAS VERY REASONABLE, EXTREMELY KNOWLEDGEABLE AND WELL PREPARED AND ALMOST ALWAYS AVAILABLE.(NIGHTS, WEEKENDS) I DON'T HAVE ANYTHING BUT PRAISE FOR HER AND HER HUSBAND. ANYBODY IN NC, CALL CAMERON LAW.
    I'll be watching, you may never know when or how, but I'll be there. I am there now....

    Wow ..I am so sorry for all the horror you went through . Glad it is better for you now..long road that actually ended .. good for you.. )
    I live in SC I wish in I was in NC.. I would definitely hire your attorney. We have been battling the same question but when contacting credit counselors they have believe it or not told me bankrupcty would be in my best interest, I called the non profit CCC .. They were prettty helpful it was a over the phone counseltation but we have been down a long road our selfs it is so frustrating .. Well your posting was very helpful and just reassures me I am going the right direction you are right bankruptcy is not want anyone wants to do and it is a very hard descion that is why I think people go back and forth it is the one of the hardest descions to make . If you know any good attorney's in the upstate SC area please let me know. Take care and i wish you all the luck in the WORLD...

      hi invest, i am also in s.c. and i am waiting on my 341 meeting. i am using moss and reed law firm out of greenville, and i am so pleased with my experience with them so far. they are very understanding and very upfront with all my questions and needs. i will keep you posted on my future experiences with this. i just hope that my 341 meeting goes as well as planned. good luck to you and please keep me posted on your experiences as well.

        I have a consultation with them on this coming up week . How odd is that. I am glad to hear you are happy with them. I am also looking into spartanburg .. I will keep in touch and you do too please glad to see somebody in my area .. I hate what we are going through but they do say
        " this to shall pass"...

          that is true, i can`t wait for this all to pass, i never thought this would happen to me, but i see i was wrong. and yes it is good to know that i`m not the only person in s.c. going through this mess, not that i`m glad you are it is just nice to have someone to relate to on my experiences. keep in touch please

            Another South Carolinian here. I filed Ch 7 last week and my 341 is set for Aug 19th. I am still feeling nervous. I can't wait for all this to be done and over with so I can move on with my life. I thought that the phone calls had ended and just a few minutes ago one of them called. I didn't answer it. They never leave messages, so far anyway. Anyway, wanted to say hi and to let you guys know that you aren't alone.

                welcome babycakes!!!this is a trying time for us all, just know that you are in the right place, we all have been there done that or are on our way to doing it. whatever questions you may have, someone here is bound to have a good response for you, i love this forum, it has helped me sleep much better at night just knowing i have somewhere to vent. please keep us posted as we will do the same. good luck to you!!!

                  Thanks!! I am having many sleepless nights. I won't sleep well until after it is all discharged and over. I know I easily qualify for Ch 7. I worry that some creditor is going to protest and they will dismiss me and then I will be totally screwed. It's just the waiting and wondering. It's driving me crazy. Does anyone out there have a crystal ball? lol.

                      I dont live in South Carolina - sometimes I wish I did it is such a beautiful state. I live in Tennessee by the way. I know a lot about those debt consolidation companies. There are a few, only a few, who are really reputable. When looking for one you should not look for the for profit companies, but the non-profit ones. Anyway, where I work at the BBB in Germantown, Tennessee, we have been inundated with calls from consumers who have gone through exactly what you describe. When these companies first got started they failed to tell the consumer he/she had to continue to pay their bills until they worked out a plan with the cc companies which could take as long as 3 months. Meanwhile, the unsuspecting consumer assumed their bills were being handled so that didnt pay and lo and behold the cc companies were hounding them. They could have cared less who was paying but that someone was and of course it would be the consumer. It was a nightmare in the making for a lot of consumers. Frankly I dont put much stock in them. The first thing we always advised people to do is talk with their creditors. There was no guarantee the cc companies would even agree to such interest reducing plans. They didnt have to and most of them didnt want to. The debt consolidation companies boasted they could do this and that and had never had a conversation with the cc companies. Most of the consumers landed just where we all are...in BK court. Their fees were outrageous and quite frankly if you could pay their fees why would you be calling them to begin with regardless of what they promised. One lady told me it sounded good until we did the math and she was paying the debt consolidation company as much as the interest she owed. Fortunately, people have gotten wise to them and our calls about the debt consolidation companies has decreased drastically. It is hard sometimes to keep up with the financial sharks out there. But you have chosen an option that will give you a second chance. I think the overwhelming majority of us are honest and have just been caught in a financial roller coaster that we cant get off of due to all kinds of unforeseen events; ours was medical and loss of job. We dont plan to do what we are doing but we simply have no recourse. Good luck. The 341 is not near as ominous as you think. I was scared to death and pleasantly surprised it was over in a matter of minutes. There is the wait post 341 but you can survive that too. The end is in sight.
