    No reaffirment agreement?

    We have a car loan and have always paid on the car, never missed a payment. The payments are pretty low and the car will be paid of in 11 months. We already had our 341 meeting and are supposed to sign our reaffirments agreements by 06/30/08. The attorney said they didn't receive one from them (Wells Fargo). I called the Banks Bankruptcy department, but it's impossible to get a live person. I left a detailed message asking for a return call. What happens if we don't get one from them or don't get it signed in time??
    I know they can come and repo it even if we are current on the loan. What are the chances of that happening?

    dO NOT LET THIS GO............ send a certified letter to Bankruptcy Div of Wells Fargo requesting reaffirm papers for your auto.

    Do not let them repo or come get an auto that almost paid off, and then resell it and make more money off you....

    Your attorney needs his A** kicked, he should be handling this for you.... he knows who to call and what to say.........

    Most reaffirm papers are signed at the 341 meeting, so it may be that Wells Fargo is not aware that you want to reaffirm on the auto.

    If you plan on keeping your auto, better get on the stick and get this took care of....

      Forget about reaffirming the car. If you have a payment coupon book, just keep on making the monthly payments on time. If you don't have any payment coupons just walk your check (noting your loan account # on it) into a branch.

        Update! I finally got a hold of a nice lady in the bankruptcy department and they will mail it off tomorrow and the lawyer should have it by the end of last week at the latest. She was happy to hear that we want to reaffirm the car, lol.

          That's interesting....I never knew that a lender would repo a car if you had no reaff, but were current on all payments.

            Yes they can repo even if you are current.

              Some lenders require Reaffirmation Agreements and others do not. Find out from your lender if they require it. I am reaffirming 2 debts -- 1 requires the Reaff, but the other doesn't care. The one that doesn't care said just stay current and you're fine. Play it safe and request the Reaff.

                They tried to push me into a reaffirmation...it wasn't going to happen. In the end, a Credit union, yes a credit union, offered me wholesale if i could come up with the cash in 3-4 months...

                  Just now, I recieved a Request for Discharge...Does this mean it's really over or could there be a possibility of it not closing?
