    Went for free consultation with Attorney

    Yesterday I went to see an attorney for free consultation, she said that I could file chapter 7, she told me that we have to wait until it has been 90 days since I used my credit cards, I used one of my cc to buy groceries a week ago but made a payment this week, it comes out of my checking accounting automatically. I haven't missed any payments yet, she told me if I could continue to pay until I filed but make sure I have taken care of all of my necessities first, her fees with filing fee included is $1499. She never asked me about my monthly expenses, which I thought she should have, I told her I have a car loan and credit card with a credit union and would it be a problem if there is a cross collateralization, she said no, that I would not be keeping the credit card and if they didn't want to negotiate then I could turn in my car and get a new one; I have a 2006 Kia, still owe over $17k, I have to give her $300 nonrefundable fee, and bring in 4 yrs of taxes and 6 months of paystubs.

    Today I went to another attorney that I like better he took more time to explain everything, went over all of my expenses, his total fee is $1674 which includes pre and pos class you have to take and after the bankruptcy is discharged they go back and clean up your credit to make sure everything shows IIB, he told me to stop paying the cards and if I used one less than 90 ago when I file to buy gas or groceries it shouldn't be a big deal, I haven't received my stimulus yet so he said make sure to spend it but not on luxury items, he said I could call him if I thought of any other questions and I could retain him for $100, Once I pay the $1674 he could file.

    I'm so ready to get this started and over with, I plan on using most of my stimulus as a down payment and maybe file no later than August, I forgot to ask him once I retain him and the creditors start calling can I tell them to call him?

      I live in Nevada, the second attorney told me that sometimes the trustee will take it if you receive it after you file, mine should be mailed out 6/13.

        Be sure to keep receipts so you can show what you spent your money on.

          It is important to chose a lawyer you feel comfortable with. What did the second one say on the cross collateralization?
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

            He said that he don't suggest that I keep the credit card, he gave me a brochure for 722 redemption and said I might want to try calling them to see what they can do for me; he said more than likely the credit union will not want the car back. I don't really know what to do, should I keep it or try to get another one? My interest rate is 5% I know anything after bankruptcy will be a lot more. I haven't tried to contact 722 redemption yet.

            I saw on CNN that SUV's are not selling good now because of gas prices, the credit card with the credit union is almost $5k I don't want to keep it and the trustee probably won't let me, but I have to have a car. I guess I have to wait and see what happens with the credit union.

              I have a V8 SUV, and I saw that piece too. I want a better gas mileage vehicle. I will probably get one after I file.

                What are you thinking of getting and are you using 722 redemption?
