    reaffirmed or not??

    Texas bankruptcy filed and discharged in 2002.

    We listed in the petition we would reaffirm our manufactured home when we filed for bankruptcy. We never received or signed any reaffirmation papers with this company even though contact was attemped by our attorney several times to get this accomplished. The bankrputcy has since been discharged and our discharge papers show that we were willing to reaffirm this loan but like I said, no reaffirmation papers were ever signed. Now in our credit reports it shows from Equifax as pays as agrees but no balance due, transunion showed paid as agreed with no balance due, and experien shows included in the bankruptcy with no balance due.

    My question to you is did we reaffirm or not?? If not, then when the time comes to movel, what do we do? If we walked away from it, I assume they would come and take it but would we be responsible for the difference in what they get versus what we owe because we definately are upside down in it? Would that have another negative impact on our credit rating?


    Also- This company will not send us a payment book unless I call every year and request one. They mention something about it being it bankruptcy but are never clear as to what they mean.

    I don't know a lot about this, but I do know that if you never signed a reaffirmation agreement and they never agreed to one, you can continue living there as long as you continue to make the payments, and you can also surrender it when you are ready and you will owe nothing because the debt was discharged through the bankruptcy.
