    Motion to Dismiss Granted -- Must Refile Tomorrow

    For all those that have answered my questions, read my posts, wished me luck, etc...the battle is over for now and the UST has won. I have learned a lot through this whole process and if I knew then what I know now, well...I wouldn't be in this position.

    Phantom income from sales of stock options and ESPP shares skewed my income abnormally high during the 6 months prepetition which allowed the UST to overstate my actual income and force corrections to my Means Test calculations.

    It doesn't seem right, but it is what it is. My attorney argued that the income postpetition should be considered, but the judge ruled our Ch. 7 filing under the Means Test was abusive if the extra income was factored in. He agreed with my attorney that I would qualify for Ch. 7 given my most recent 6 months income. The attorney for the UST also agreed that if we refile immediately with the new income from the latest 6 month average, then he won't have a problem with our case. This is complete insanity...

    So, now we have to refile and go through another 341, wait another 60 days with no objections (we had none the first time around), then hope the UST lets us through under the new petition. What a waste of time and money! But I guess this is the Government isn't it -- the Dept of Justice oversees the UST Program. Waste, Waste, Waste

    For me, I am emotionally drained and can't do it anymore. I will do whatever I need to do, but I can't dwell on this. I can't look at BK Forum everyday and monitor PACER either. I am a broken man from this broken BK system. I won't be posting much anymore, but maybe in 4-5 months you will see that I finally received my discharge.

      getouttadebt, don't leave or ignore the forum. You are among friends here. And as you know, you will find great support here. Good luck in your plans to go forth. My own case, as you know, was not a walk in the park. The only objections we had came from the UST and that dance saw us through a Rule 2004 examination and a 60-day extension to await the discharge. It IS emotionally draining. I can certainly vouch for that. But the sun will come up tomorrow and it will be a brand new day. Get your chin up and seize the day. Best of luck. Keep us posted.

        Sorry to hear you have to refile. I wish you luck and hopefully we will see a post soon saying you are discharge.

          I am so sorry to hear that!! I take it you were at least dismissed without prejudice? As you may know, we are in a similar situation but a couple weeks behind you. Think about how much more you know now than when you went into this process. Don't give up! The UST was the only one who objected to your discharge and if they've said they won't object if you re-file, I think you are in good shape!

          It is a lousy, broken system... but don't let it beat you. These are all hoops we have to jump through and I know how anxiety-provoking and depressing it can be, but it won't last forever. I understand needing to take a break from the forum, but the very best thing we can all do is to share what we've learned and to support each other.

              Very sad. I'm sorry for you. Give it another shot. Hang in there. The light is at the end of the tunnel for you. And you have gained a lot of knowledge. Keep checking in with the site to keep your spirts up. The forum is all about people in the same boat.

                I'm really sorry to read the UST won I had been following your threads to see what happened and it truly is a waste that you have to refile ! I wish you luck in the future and I hope you get some peace sooner rather than later. I hope you see this but understand what you mean about needing a break from it all. Good luck

                  Look, “Gettouttadebt”, you are no worse off. They cannot get blood from a stone. I am going through what you have just done but worse (in my opinion) as I have an evil adversary that will go to any means to destroy me. He has an AP against me now and he is not even a creditor. YOU have helped me on several occasions with your presence. When you display this obvious disappointment, it brings many down. You are made of better cloth than you realize. STAY with us, give the rest of us hope and also we do same for you. WE are pioneers as you can bet with what is going on with the economy, there will be many, many 13’s and 7’s. RECONSIDER!!!!!! ‘Hub

                    This sucks big time, but you are bigger than this and can do it. If you were not, you never would have started the process to begin with.

                    So suck it up, chin out, chest up, and onward.

                    You can do this and will be glad you did.

                      Thanks, ep -- and thanks everyone here! We have started the process again! New case #, new 341, same UST. My attorney proactively showed the new Means Test and went over Schedules I & J with him before filing the new petition. The UST says he has no issue with the new filing! So, I feel optimistic again...we'll just have to wait and see how things go.
