I just got an email back from my lawyer's asst that said we do not have to take the means test. He didn't explain why even though I asked because I noticed on our finished BK paperwork that it was all left blank. Why wouldn't I have to take the means test? We are way below the median income, would that be a reason why?

You only fill out the first part if you are below the median income.
If the debt is primarily business debt rather than consumer you don't have to fill any of it.May 31st, 2007: Petition Filed by my lawyer

In my case, I'm JUST below the median, plus due to a stepchild situation we did the means test just in case the trustee disagrees that I have a four person household. But, I would say if it's a clean-cut below the median case, then it's not necessary.Filed 6/10/08
