    Car repossession

    Hello,
    Just wondering if someone could help me out with a question. My bankruptcy was dismissed in August of 04. My car was also included in the bankruptcy, but I keep it and continued making payments. I never signed a reformation agreement or anything. Well about 3 months ago I voluntarily gave the car back to the financing company. I checked my credit report and it states this: "included in chapter 7 bankruptcy/repossesed"

    My question is how can they put repossesed on my credit report? Is this legal? I never signed anything, and the car was included in my bankruptcy filling. Please help.

    Good question. I would like to know the answer to that one. We too are discharged and our truck was included in the BK and we want to surrender it in about a year. We did not sign an affirmation agreement either.

      The car loan was included in the bankruptcy, and the car was repossessed, so yes, the entry is accurate.

        Anyone else know? The lawfirm that I turned the car over to told me that if I voluntarily give the car back that it wouldn't be considered a repo since it was included in my bankruptcy. At first it just showed incuded in chapter 7 bankruptcy. Now they have went back in and put /repo beside it.

            I don't know for sure, but I suspect that it is an accurate entry becaue the car was included in the bankruptcy.

            You should go ahead and dispute it as perhaps the more accurate description would be "included in BK/Surrendered", but I don't think that entry is any better than a repo entry.

            There is no harm in disputing it.
