My wife recently left me which forced me into bankruptcy. This is due to gamlbing and excessive spending. Will i need to provide legal seperation documents at the hearing stating she will not be assist with the bills? With her income we could scrape by but alone I am dead meat. This is a tought tim and very curious about this. All the debt is in my name except a school loan which we are joint holders of

As a general matter, if you two are splitsville, get the divorce then file BK, its just cleaner that way. (however, with the new law looming, that may not work out). Next best option is a seperation agreement listing the seperation of assets and debts. However, its not absolutely required to file BK. You will be underoath at the 341 meeting, so you just tell them your left you and she is not cooperating.

What do you meant "with the new law looming, that may not work out"? Why? Anything new from the new law about separation/divorce impacting the BK? Please advise.

I only mean that there may not be time to get the divorce finalized and get your BK filed before October 17. I don't know how far along you are in a potentional divorce or how contensted it might be.
