    Error on account number in filing

    My attorney filed for us on 3/26/08 and listed an account erroneously. Now I'm having issues.

    It was for an account I had, that I paid off, on time, several months before filing. I also had another account with the same bank that I wanted to include in the bankruptcy. When preparing the paperwork for filing, he used the account number of the paid account, and neither he, nor I, caught the mistake, until the bank started reporting me 30 and 60 days late on my credit. I called my attorney, and he assured me, that, regardless of how the account number was listed, that it would discharge the correct debt. Is that correct, or am I gonna get stuck paying a debt I wanted to include?

    I'm not one to simply sit by and simply take the attorney's assurances. We have a very BAD one, that's why. So I would INSIST that he/she correct the paperwork, even if you have to pay $26.00 to have the petition ammended. Having that little i dotted and t crossed for sure will make you feel a lot better.

      Discharged yet??? If not have the attorney re-open the filing, delete the wrong account number and insert the correct account number, and have him call the cc outfit to fix their books.

        May 28th - Filed for Ch 7 (FINALLY!)
        9/11/09 - DISCHARGED!!!!

          I thought if you are filing a no asset C7, all debts you had prior to filing will be discharged.

            Account numbers are not necessary in the filing actually. So yes in a sense the lawyer is correct. Ask him about amending the papers to include it so that it will be smoother sailing
            May 31st, 2007: Petition Filed by my lawyer
            July 2nd, 2007: 341 Meeting Held
            September 4th, 2007: Discharged and Closed.
