Hello I am considering filing Ch7 Bk and had a question. I am married. If I file by myself can I use expenses for us as a couple such as groceries?

My wife is currently unemployed and does not contribute to any of the household bills.

I would defineately think so. I have a friend who was in the same situation His wife was pregnant and not working. There was no problems with his BK Good Luck!

Absolutely you are married. Whether she is working or not is irrelevant. Use the expense calculator on this forum to get a general idea of what your monthly expenses are. Once you consult with an attorney he will advise you on what is allowable and what your exemptions are. Good luck. Congrats on the baby to come!

Don't forget also.. many states have statutory exemptions, inside and outside of BK, for Heads of Family. It's a very good position to be in as far as BK, wage garnishment, bank account levy.. the whole works.

Where are you filing and will you use state or federal exemptions?
