Do the trustees look in detail at these? I filed just last week but the most recent charge on one of my CCs was date the 12th. I made my last payment in June. I forgot to move an automatic charge so that I would pay cash for it instead of having it charged to my card automatically. We (my dh and I) have a lot of debt ($85K on CCs alone) so I'm worried how closely they will be looking.

How many charges have you made in the last three months? If you made a lot of purchases during that time period, there could be a problem.

As far as the autopayment, I'd just tell your attorney about it and offer to just pay that back so the trustee doesn't think you're trying to slide on that!

Uh oh. I may be in trouble then. We put some purchases on one card for gas and groceries and I didn't think anything of it since I was still making payments on it. I guess I will need to talk to the lawyer about it.

What will happen with these charges on the CCs. Do they dismiss the filing? If so can I refile after a certain time period?

Living expenses are different that you having charged jewelry or fun stuff like a vacation. Have you kept all your receipts? That probably will help your case, BUT in all likelihood, the worst that could happen is that they will expect you to pay those expenses back, not the entire $85,000.

Have you asked your lawyer about all this? He/she probably will have the best answer as having seen all your data first hand. Either way WHY pay the credit card companies if you plan to file? That is a waste of funds. Use your cash to pay your attorney.

My husband and I owe a lot too and we are having to wait on filing. It's so stressful and I've just now quit paying my CCs but he stopped a few months back when we decided to walk from our home.

Yeah, I stopped paying as soon my attorney told me to. It's all just living expenses so we should be OK. I'm going to set up a meeting with my lawyer before the 341 meeting to go over all the questions I have and I'll bring this up.

I will be so happy when this is over. I have a budget all planned out and the lifestyle changes we are going to make. It'll be tough the first couple of months but once it is all done I'm sure it will be worth it.
