    Trustee issued declination!!

    Does this mean what I think it does?!? Are we all set with the U.S. Trustee now and just awaiting discharge?

          Yes it does!!!!! Congratulations!!! It means the UST is agreeing to allow your BK case to proceed (but probably with some conditions - you should read the actual statement). You are on your way to being discharged...

            I don't see any conditions. Would it be on the actual declination? (I pirnted it and there is nothing about any conditions)

            There was a mistake on our income. THey took the 6 months but we are not earning that money. It says after readjusting that the income is accurate now and below the threshold.

            So now I am waiting for objections, correct?

                    Just curious, did the UST mess up your income calculations originally?

                      No, she didn't mess it up. It actually changed right after we filed. It looked like we were still contributing 800 to our retirement but we had stopped it so we could keep our house. Originally we were going into foreclosure and giving up the house. We didn't have the money to get current.

                      My dh rememebered we could get it from our retirement for " emergencies" and we were able to save our house. Since we were keeping the house we needed more money to be able to afford it so retirement was stopped.

                      Trustee never got that info until very recently. It was what prompted the presumption in the first place because she saw it as "disposable" (which I can understand) but it really wasn't.

                          It was around the same time as the filing but paystubs didn't reflect it because it took a few weeks to do. Schedule J didn't reflect it either.
