    341 meeting

    Hi everyone I had my 341 meeting today 8\3\05 didn't go as expected. The trustee did not ask for any paperwork but I had 300 dollars left as disposable income he said I would have to switch to chapter 13 which is not so bad a 300 dollar a month payment is better than the 1000 dollar a month minimum payments I use to make. I don't have to go back for the change which is good but anyone out there the meeting is not bad if your honest and don't have disposable income over 100 dollars it's a breeze. This was filed in tampa florida. Thanks everyone for your great insight on this site.

    Did you use an attorney? He would have "assisted" you in allowable expenses for your region. I will be going for a ch13 very soon for similar reasons. I like your positive attitude that paying something for a few years, and getting a discharge is better then being in debt for 20 years. Personally if more people that could pay something did this, the govt. wouldn't have changed the laws to begin with. (Just to be straight I'm not knocking anyone that fell on hard times and are really dirt poor), but I feel folks like you and myself that can pay something for 3 years should and it's still a better deal then having a ball & chain for life!

      Good luck! and kudos to you for your great attidude.

      I was worried that we would have to do a 13 as well (who knows, theoretically they could make us switch as our objection due date is 15-Aug) but I stopped worrying about it as whatever we would have to pay in a 13 for 3 or 5 years would be better than the $2000+ per month we were 'paying' before, with NO end in sight.

        I like your positive attitude too. If we had been converted to a Chapter 13 it would have been disastrous but I am glad it can work for you.

          I tried to do a Chapter 13, but lawyer advised against it. Said I would have to buy back home at 100% and plus pay creditors also - and there was "no way" I could afford the monthly payment the court would require.

          So I really had no choice but filing 7.

          Feel bad about some of the creditors - some I don't....
          Some tried to work things out with me, others just raised interest rates to 29.9% and tried to screw me over....

          Many ways of looking at it - you do what you have to do in the end!!!!

            Minny, the only creditors I feel bad for (not in my case, just in general) are the Doctors, Dentists and Hospitals. I always felt that as long as someone has the means and they are in good health they should pay back even a small portion of these bills. As for an unemployed or disabled person is another story. I think that the high cost of medical insurance that we all pay for is because of so many defaults. Also we all need these Doctors to survive to cure us all now and in the future.

            Credit card companies however always made me laugh. I just got home from work and found 3 more "pre-approved" applications from Chase in the mail. I average 15 a month. They kill us with their TV/radio commercials, billboards, internet pop-ups, mailings, etc. and when we take them up on their offer and get in over our heads they all cry fowl and bribe congress to re-write the laws. It's not their fault for my problems, it's mine and only mine. Again I just laugh at their system for granting so much unsecured credit and crying in the end.

            PS.. Very cute dog. I have 2 of my own and hopefully they are both exempt assets. If not I will transfer them to an insider legal or not!

              I felt bad at first, but not anymore. Other than a loan from my dad and the car loan i reaffirmed all I listed were 4 CCs. 1 Citi, 1 AT&T, 1 Sears (all 3 through Citi) and 1 Best Buy (Household) I figure I've paid enough interest over the years as the Citi was from '92 (my first card since they like to target kids going off to school) and while the Best Buy was the newest at a few years old, the interest was crap. They've all got their money back and then some from me so I no longer feel guilty, especially since they bring it upon themselves with the way they operate. They are really just legal loan sharks, while they might not break your legs, they have other ways of "roughing you up". I get a kick out of how they operate too, if they are really worried about getting back all their money maybe they should be a little pickier about who they give cards to and send offers to. I remember getting AmEx gold offers preapproved for $5K or more when I was 12 and thinking wow just think of all the toys I could buy. Just a big waste of postage for them at the time. I've heard of people getting offers for their pets also. I believe one said they signed up for something and put their pets name on it and next thing they knew their dog was getting CC offers. Maybe you should check your dog's credit rating. ;)

              I agree with you about the health care providers though, but the insurance companies themselves are also partly to blame for their woes. Many pay claims extremely late or outright deny claims that should have been paid and leave it up to them to try and get it out of the patient who in many cases can't afford it. A good medical insurance policy can also get you better service though if they are prompt with payments. My sister said when she schedules appointments they love it when they hear who she is covered by. Her hubby's company is self insured and pays all the claims very quickly so she said the offices seem more accomodating about finding an opening that will work for her. You can also thank all the lawsuits for higher medical costs and higher insurance costs. The malpractice insurance rates these days are driving many out of business.

                I feel the same way about the medcial bills. Unfortunately, my mothers medical bills, that I assumed after her death was what helped force me into BK.....

                Many were ambulance bills that were coded wrong and her insurance refused to pay.....(The ambulance company would not re-code and resubmit in order to get paid), a private ambulance service. At $1,000 a pop one way, it didn't take long for them to really add up.

                Also they gave my mom SS benefits for two years, (she was not entitled too), then "screamed" we want it all back after they discovered their "error". During that two years she was in the hospital 4 times - and in rehab 2 times... So you can imagine the medical bills they were wanting PAID FOR....

                Some bills were bills that SS said insurance should pay, and insurance said SS were responsible for!!!! In the end, my mother got the final bill for the ones nobody wanted to pay.....

                As her POA I was responsbile before and after her death.....

                So needless to say, I was well pushed into bankruptcy....

                  I know all about those bills from when my mom's cancer came back and she passed away last year, but luckily for all of us my dad had really good insurance that took care of everything. There was the occasional problem like when they were refusing to pay for the liquid food she needed since she had a feed tube and would never be able to eat regular food again, but in the end everything worked out alright. I can just imagine how much your bills were adding up to as hers were very steep and made worse by going to Mayo Clinic again. Luckily she was able to get the doctor who operated on her 15 years earlier and even back then was one of the top 15 in the world for that field of medicine. He just happened to have an opening in his schedule when she called and squeezed her in since she was kind of a star patient. She was the first patient they used a certain procedure on which has since become standard, plus I'm sure the kringles and baked goods made her popular with him and his staff. They sure don't mess around there either as while going over her test results later the day of her appointment he informed her he already had a surgical team ready to go first thing in the morning. It's just too bad she wasted so much time with local doctors that didn't know what they were dealing with or she'd probably still be with us and enjoying the new grandchild my sister gave birth to 2 days after she passed.
