Filing Myself, Have questions on Forms

    #2
Statement of intention: Mark the house as Exempt/Reaffirm

Schedule C: you will need to find your states exemptions laws, generally, the good BK packets include that. There is a list of some of the states exemptions laws on this forum, but it may be out of date.

Schedule D: None of those things apply, so don't check anything, unless you dispute the amount owed to the creditor.

Schedule F: That is your list of Unsecured Creditors. (don't worry about the consideration part). A setoff means, do you have a claim against the creditor which would offset (i.e. reduce) what you owe them, (probably not). Unless you dispute the amount owed, don't check disputed, and likewise, for most standard debts (i.e. credit cards, etc), contingent and unliquidated doesn't apply.

Generally, an unliquated claims means that whatever you owe has not been reduced to a dollar amount. I.e. Lets say your dog bite somebody, you are liable for damages, but since the case has not gone to trial, nobody is really sure how much you owe, hence the claim is "unliquidated". Contingent claims generally means that some condition needs to be satisfied before the debt arises.

      HHM,

You and Todd explain these so well and in simple terms that we all can easily understand......

Thanks so much for making "legal language" simple for us "simple folks"....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

I filed Ch 7 by myself. I recommend the two following sources highly:

        1. How to File for Chapter 7 Bankruptcy...NOLO...www.nolo.com $29.99

        2. Form 7 Bankruptcy Software...www.Form7.com....$34.95

In fact, the guy that designed the software used the NOLO book as a reference....Between these two sources, all of your questions will be answered.

WOW, I just was reading on other cases, and I am so glad I read this thread. Originalhealer, thanks for the info. I am downloading the program right now. This is exactly what I was looking for, and thought someone/somewhere had to have it?! I was going to buy the kit at OfficeMax, but couldn't get any conformation it worked.

I am doing all this for my mom. I have my own thread about her, I think her case is pretty cut and dry. She has NO assets, her only possession is her car that's only worth about $700, and furniture that's about 7 years old and wasn't more then a few hundred dollars new. Anyway, I think it's going to be very easy to do this on our own without an attorney.

My question is.. should I still get the book you recommend? I HATE reading books, and most of the time, it doesn't even make since. If the software can walk me through the forms, filling them out, all I have to do is file them with the BK court right? I'll get the book if I need to, just don't want to get more then I need for a simple case.

          Thanks!!

The software is pretty self-explanatory, but the book gives background info so that if you run into any problems, you have something to refer to. But it's your choice.
