At the meeting, does your attorney speak to the Trustee for any reason? I know the Trustee will ask you questions, but will they ask your attorney questions? Does the attorney answer anything for you or help explain something?? Any info would be appreciated. Thanks.

Question about 341 Meeting

I filed Pro Se, so I got asked all the questions from the UST. But I sat in on a half dozen cases ahead of me in two separate 341 meetings. Each time, the UST asked questions both to the attorney and the filer. For the most part, pretty relaxed environment, but there was one case I remember where the person was on welfare and didn't have a bank account, and that created problems with the UST, because after the show me your ID question he wanted to see a bank statement showing money in the bank AT time of filing. He ran this gal through the ringer for not having a bank account. Asking, how does she cash her checks and pay her bills? He lectured her on why she should maintain a bank account in order to keep better track of her money. Her attorney didn't make a sound....
I was wondering how could she afford a lawyer being on welfare...

It was a mixed bag the day of our 341. I observed almost every meeting that day (we were last to be seen and there were probably 100 cases that went through 3 different trustees). Some of the attorneys were asked questions, some weren't. Our attorney wasn't even present at our 341...he was at the next table with a couple being grilled by another trustee (they must have been a 13--too many assets with other complications).Filed BK (Ch. 7) 6/2/08

We fielded all of the questions at our 341 hearing. We glanced (glared?) at our attorney repeatedly when the case trustee and UST grilled us about all the things he said "were nothing to worry about". I half expected him to step in and say something like "that was what I advised them to list" or "that number was calculated from [xyz]". After each period of silence waiting for him to say something, we fended for ourselves (carefully answering the question so as not to appear that we were blaming or badmouthing him). With the UST present, I think he was especially nervous and was concerned much more with covering himself than "fighting" for us.
