    341 Meeting Today-Not so Bad!

    Hi Everyone.
    Wanted to share our 341 experience with you all...
    our meeting was held at 130pm today and there were only about 5 total cases. We watched a two before us which of one of them took literally 2 minutes and the second one took about 15 minutes. The trustee asked this guy who was a real estate agent a ton of questions about his income. Apparantly the guy had escrows open that he did not put into his filing paperwork. He then listed on his expenses sheet that he had $600 in legal fees, $800 in meals and entertainment per month as well as $1200 in commissions he paid out to no one specific. The trustee was very mad and said that he would be requesting several other docs. This poor guys attny was not present. Trustee scheduled another meeting where he had to provide proof of all of these expenses for the last 6 months.

    By the time it was our turn we were really nervous. Ours took about 5 minutes. The only thing that may come up as a complication is that we had thought in our initial filing paperwork that we were going to keep two of our cars but now post filing we decided we could do with one and buy a really cheap car post discharge. Trustee told our attny that this might affect our means test. Also we had just filed our 07 taxes and trustee had not recieved them yet. He was fine and just asked our attny to forward to him by a specific date.

    I noticed that our attny and this trustee had a pretty good relationship. They were talking about mutual colleagues and associates. They joked about judges etc. This made us feel better. After the meeting, attny said that's that now we wait 60 days and it will be over.

    One final thing...I guess since we had over $100,000 in unsecured debt, the trustee thought the UST would get involved...attny informed trustee that he had not heard anything from UST. Does this mean we won't at all if not by now?

    Congrats Whoops, glad it went well!

    Technically the UST can get involved at any point during the 60 days, and they have 10 days from the date of your 341 to file a statement of presumed abuse. However, judging from just about every posting on here who has had to deal with the UST, if the UST is interested in your case they usually will contact you and your attorney either sometime before the meeting (requesting additional docs), or they show up at your meeting.

    At least in our district anyways, our lawyer told us that since the UST did neither in our case, it was a good sign, making it unlikely they will get involved (we are also discharging $100k+ in unsecured debt). So hopefully the same applies to you
