    Monday was day 61. Discharged - NO YET!!!! The trustee on Monday asked for a 60 day extension before discharge. Judge has not signed it as of today but he usually does whatever the trustee request.

    THat stinks, why did the trustee do that? What do you think they are trying to do? (dismiss, convert)

      Sorry to hear that. Is this the local trustee or the UST filing the extension? I think I remember in a previous post you mentioned you were an asset case, so maybe that is why?

        Flame, we were like into our sixth month. We called and all we needed was a marriage certificate and we use our sir names. You may wish to call your clerk, check your courthouse as you have one, and see what or why.
        If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

          Hi Flameout: We filed 12/28/07. The 341 was 2/7/08. Our original Last Day for Creditor Objections was 4/2/08. But sometime in March we were ruled an Asset Case, and an extension was granted for Creditor Objections to expire on June 12.

          That date passed and went on, and went on. We thought our request to discharge our counsel and go pro se might have had something to do with it. That hearing was 8/6/08. Still no discharge. We called the clerk of the BK court and found that they needed a copy of our MARRIAGE CERTIFICATE, with which we brought two copies with so that we could give one to the Trustee. No, he didn't need it...... GGGRRRRRR!!

            The letter I received from the trustee and my attorney about 30 days ago stated that the trustee was looking at the homestead exemption and my pension. What I do not understand is that being in Texas it is a very clear and cut situation. The homestead is 100% exempt and so is the pension. My home has been paid for and lived in for over 13 years and my pension is a municipal pension that is clearly exempt by the State of Texas.

                You guys are not going to believe this one. My attorney called today and the trustee wants my tax returns from 1995 to 2002. Somehow it has to do with the exemption on the house. Good news is that I still have them. I believe that I have a goofy trustee.

                  Wow!! I think you take the prize on having a Trustee looking back that far! Good thing you still have the tax returns!

                    Wow, 13 years back? I'd be pretty screwed if I was ever asked that

                    And this is the local trustee asking for this, or the US trustee?

                    Plus I always thought questions on assets would only hold up closing and not discharge

                        I admire your spirit! I'm afraid that even if I had ready access to all that info, I'd be a complete wreck over it, which is silly. You're absolutely right, though...the law seems clear, you've been honest about it, and there's no reason this shouldn't be a simple case. Just imagine all the work this klutz just created for himself.
