time line ???

What is the time line from the time you file at the courts til the time you are discharged, and during that time since you can't pay your debt what do you do with the money??

I filed first week of June, had 341 first week of July, last day for objections is first week of September. And you should still have bills outside the debt you have included in BK.

I still have one car payment, my rent, electric, food, gas, kids stuff for school, etc.

Once you file, you'll get a letter giving you your BK case # and the time, date, and location of your 341. It took about a week for us to get the letter. The 341 can be scheduled as soon as 1 mth later but ours was scheduled almost 2 mths after we filed, probably due to the number of re-affirmations we requested. Once the 341 is held, there is a 60 day waiting period for trustee and creditor objections...that is the date of your tentative discharge. I say tentative, because it's not set in stone...many people here have discharges which run later than their 60 days. Closing of your case comes later, whenever the court wraps up their end of the paperwork..it could be same day, it could be weeks later. It marks the official end of your BK case.

As for the money issue...use it reorganize your life. If you are giving up a home, it could provide you with the money to get into another home. If you're giving up a vehicle, it could be used to buy a good used one or as a down payment for another one. You get the point. If none of these apply to you, save it and have a cushion for your fresh start. Good luck!

We filed C7 on 122/28/2007. The 341 was 2/7/2008. Our original last day for creditor objections was 4/2/2008, but we were ruled an Asset case in March and our last day for objections was extended to 6/12/2008. We finally were discharged on 8/13/2008. The holdup? a copy of our marriage license for the file! I had a copy at our 341 to give to the Trustee and he said he didn't need it. GGGGRRRRRR!!!!

Even though we have been discharged, we aren't through yet. Since we are an Asset case, we have to pay $450.00 a month to the Trustee to buy our stuff back from the BK estate. This started 5/1/2008 and will continue through 4/1/2009. We also rreaffirmed a car and thee payment for that is $485.00 per month. That should end about March. So with these two large payments, we have NOT been able to save anything aside yet, and had to borrow some money from our DD and SIL to pay the electric bill and put fuel in the cars, and clean up some other small bills. Once these large payments drop off next year, we should be able to pay them back and start saving.

I filed 7/30 341 is 9/17 the delay is because I know the first trustee I was assigned.
Expected discharge is 11/14. I think we will have a nice Thanksgiving.
As far as bank accounts my checks go into the checking account to pay the bills. We cash my wife’s check and pay for gas and the other house hold needs. We have stopped using our debit cards and for the first time my check book is balanced. I have yet to over draw my wallet.
