    Tax refund and stimulus

    My attorney said that my tax refund and stimulus would not be an issue in my case because it's been 5 months since I got it. He listed it and it's covered as exemption, but he said it wouldn't matter. We've been so worried they would harrass us for this. We got 7k refund. 1k was used to pay state taxes we owed and the rest we used to live off of.

    Was anyone told the same?
    8/5/08 - Filed Chapter 7
    9/10/08 - 341 Meeting - It went great
    11/10/08 - Last day for Objections
    11/12/08 - Discharged & Closed!

    Our Trustee never said anything about our stimulus check to us, but he did tell another lady not to spend hers w/o contacting him first. She was filing pro se.

    We owe so much in income tax, we aren't due for a refund in any case. In June, we got a notice telling us that our stimulus check had been applied to what we owe for 2007. That is what we expected to happen.

    You are probably okay. Just keep receipts for anything you spend of it just in case.

      From reading posts here, it sounds to me as if this is entirely dependent on your trustee. My 341 was in July. My lawyer told me it wouldn't be an issue, and it wasn't mentioned. Come to think of it, I didn't hear the trustee say anything about tax refunds or stimulus checks to anyone that day, and I heard quite a few cases before mine. So possibly my lawyer just knew that this particular trustee wasn't interested.

      All the same, I was very careful about what I spent it on, and I was pretty obsessive about keeping receipts, just in case.

        Were you already declared a no-asset case? I am guessing that if they were interested in it, you would have already heard

          Good point. I was declared no asset right away, too.

                We got a refund in March and our lawyer didn't mention anything about that or the stimulus check we got in May. If they ask it all went to the mortgage company. We didn't know we were going to file then.

                My concern is that since I got a refund are they going to give us a hard time about witholding and the means test? We are above the median income but we do pass the means test. Our accountant said that we wouldn't have gotten the refund this year and would have actually owed if they hadn't changed things related to AMT at the last minute. I have no idea what's going to happen this year since I won't have mortgage interest to deduct.
