    Ex-Wife Filing Chapter 7

    We lived in CA. We were separated ago and the final divorce paper done 2 months ago. We had a house - but the mortgage loan is under my name. We did not to sell the house as there is not much equity in it - 20-30K and continue to decpreciate. I put down over 90K into the down payment. When we did the uncontested divorce - she agreed to sign the quit deed claim to the tittle and she keep her car / bank account. She also assumed most of the Credit Cards of 80K - ALL under her name - and most of debt were there even before we got married.

    She is been on her own and not making much like 34,000K per year with 80,000 in CC and 200,000 in student loans. She cannot afford the min payment longer and thinking of filing Chapter 7 or 13.

    My question is can the Trustee or Credit come after me for soon under the water house and her credit cards det

      Filed CH13 12/31/08, abandoned March 09 after losing job.

      Ch7 Filed March 2010. 341 Meeting April 2010. Discharge and Case Closed July 2010.

        i'm no expert but i fail to see how the house is an asset she can list any longer; if she can't list it in the bk the trustee can't pursue it. this is her bk, it has to include all assets for which she is responsible at the time of filing. sounds like her car and bank account. if she has anything that was secured with the house, that might get sticky - but your divorce lawyer should have handled that too.

          Hi

          Were you an "authorized user" on the credit cards???
          May 2008 Hired 1st Attorney/Stopped paying CCs
          May 21, 2009 Retained 2nd Attorney
          May 28th - Filed for Ch 7 (FINALLY!)
          9/11/09 - DISCHARGED!!!!
