    how long before I have to move?

    I'm meeting with an attorney on Monday to file. I 'think' we qualify for Chapter 7 because of the Means Test.

    Once we file, how long before we need to be out of our home? approximately?

    Chapter 7 filed - 10/12/2005 - Asset
    Discharged - 02/16/2006

      Are you foreclosing on your home? I am filing chapter 7 and we are keeping our home. I guess it depends on what state you live it.

        The OP said how long before they have to move, I would take that to mean they are giving up the house. And it does depend on the state you live in.

          Cali - Some people think that just because you file a chapter 7 that means that they can't keep there house. thats why i asked that question.

              I know i wasn't being confrontational, really. I was just asking cause I know when we orignally talked about chapter 7 i always thought OMG i am going to lose my house and then the attorney tells us no, you can keep the house. Thats why i asked him that.

                I'm not sure that we could afford to keep the house. our payment is really high and we're behind 2 months. I cant see how we would ever get caught up.

                      In order to be able to keep the home and file Ch.7, you must be current on the payments. If you're able to afford the payments after your debts are gone, then keeping the home may be an option. If you feel that you still will not be able to keep up the payments after your debts are gone, the surrendering the home may be the other option.

                      In any case, if/once you have an attorney working for you, he/she can keep you apprised along the way how much time you may have left to stay in the home.
