So, we had our 341 yesterday. We have nothing too exceptional-we have 2 vehicles a car and a van. We are surrendering the van. We also are "surrendering" our house (I don't like to say being foreclosed upon
The sticky is my husband is co-debtor on a mobile home that he financed with his ex-wife 14 yrs. ago... long story, but now he's supposed to be financially responsible for it, we can't be, so we are surrendering it also (the thing was way over-financed at the time they bought it--to the tune of $50,000 at 12.5% for 30 yrs. plus lot rent). Anyway, we're at our 341-the ex got notified because she gets child support and when the trustee calls for any creditors present, she stands up. It goes smoothly until she has a chance to speak... then, she trys to say that we're hiding a vehicle (my dad bought a van, we just drive it-his name, his title, his insurance, etc.). At this, the trustee just shrugged and said what do you want me to do about a van in her father's name? Then she goes on and on about how we claimed 5 dependents, yet we can only claim 3 on taxes. Our attorney said this was fine since he pays child support, a bankruptcy schedule is different from taxes. Then, she went on and on about how she's not going to let this happen, that she will not be responsible for that trailer, she's not going to pay for it. The trustee listened to her rant, then asked her if she was done, then concluded our meeting. He didn't ask us for any further documentation or anything. He really seemed disinterested in what she had to say. Afterwards our attorney said for the most part, she just sounded like bitter ex-wife. She'll probably try for a civil contempt case, but yesterday was not the place for what she was trying to do. My question is, can she object to our bankruptcy? Does anyone else have any experience with bankruptcy after divorce? The sad part is, they've been divorced over 10 years and she gets no less psychotic with time...
