August 15 File Deadline?

Ok...I keep seeing this on some of the posts. But I'm confused about it. Maybe ya'll answered it...but I didnt see it.

I thought the last day to file under the old law was Oct 17? What is this Aug 15 deadline that I keep seeing?

The 14th of Oct is probably the last business day of filing since the 17th falls on a Monday. I doubt the courts will be open on the weekend.

That's true, but if you use an attorney who e-files, you can file over the weekend of October 15 and 16, and still have the current law apply to your case.

I have no idea, someone mentioned in another thread that their attorney told them they needed to file by August 15th, and the rumor took-off from there. I have not SEEN anything to cooberate that fact. As far as I know, you can file at 11:59pm on October 16, 2005 and the current law will still apply to your case.

I think what the person meant was the last day to file is October 15, 2005 because October 15 is the last business day before Oct. 17 (October 17 is a Monday, October 15 is a friday). I have seen some attorney websites that use the October 15 deadline. However, with e-filing, you can file cases over a weekend, and that will still be considered before October 17. If you are filing PRO SE, then yes, the deadline will be Friday, October 15, 2005 to get your case filed.

If someone can track down a website or news story that says otherwise, please post it.

Another poster said that THEIR atty wants them to file by Aug 15th because their bk was very involved. That's where the rumor got started. It is just for this particular poster only.

I am "that particular poster" - as mentioned in the very first reply to that deadline, my case involves certain items needing to be posted prior. As I have heard from others posting, sometimes it takes awhile for the lawyers to get your petition prepared, etc. If you're going to file - file as soon as you can.

Please also read threads carefully and fully. That thread explains everything in it as well.

I had fully read the post I was refering to. Didn't understand the concept of it. Hence why I asked why there were so many refering to this particular date. You're particular thread was not read, and I was refering to another thread that posted that date as well.

However...thank you all so much for clearing it up with me. Got hear it from the Guru's (you guys). Ya'll know more than me.

You're the one that has been waiting forever to sign your petition too right? My lawyer said we would sign the papers this week, I paid and now he's not returning my calls! I just want it over and done with - as said, I have to get it filed before the 15th because of a lovely legal situation with my piece of scum ex-fiance.

LOL...no... I didn't take it in that manner. Heck I've been reading all of these posts and I get lost in them. Yes...I've been waiting...but it hasn't been forever. Just seems like that since I've been putting everything together since November. I only retained him 3 weeks ago today...but they are telling me that they should have it filed by mid sept. That's what's seems like it's forever.

I know what you mean about the phone calls. They always tell me they're going to call me back and they never do. They seem aggrevated if I call with a question. One thing I think they are forgetting is that I paid them...not vice versa. I will let that be known next I call.
