who is included in the means test for "persons living in your house" My younger brother has a child whhich he was having a hard time caring for so he lives with me and i take care of him. Could I count him on there? I will also be claiming him on my taxes.

Yes, the rule is how many "heads on a bed",if you are supporting him, they you can count him and his child as your dependents. You will also have to include any contribution he makes to the household, excluding SSDI.

It is a test that is not nice. Actually the technical term is the B-22 Form. This is a statistical calculation of comparing your income (the last 6 months) and comparing it to a similar size family average income in your state, hence means=average. There are 2 parts to the means test, part 1 is straight up gross income compared to the CMI, if you fail part 1, then part 2 takes into account your secured and necessary expenses and determines if you have disposable income....(overkill explanation alert)Disclaimer: I am not an actor on TV, but I play a BK Paralegal in real life. I could be a little off on this I am not a pro. It gives you the amount you have to make under to file ch 7. If you make more than the median you have a worksheet to fill out.
