    The lawyer is right. You are not legally responsible for the $12,000 you charged on your mother's card. If you file bankruptcy, either chapter, it'll show up on her report. Since you're only an authorized user, as soon as you file, the company will go after your mother. It's her account.

      No you missed my point. I know I am not legally bound to pay it since I am an AU. However the lawyer said I could pay it or give my mother money to pay it as long as it wasn't included in my expenses and my income to expenses was still negative without it.

      Also why would my bk show up on her reports? Or do you mean if I didn't pay it, it would hurt her credit? I'm not understanding you.

        Did he suggest doing a BK 7?

        By law, you can't get fired because of BK or the employer can get in serious trouble - government or not. I've learned from this forum that the people who generally know are the people you tell. I wouldn't sweat that as much.

        I think its a bad sign that 'his eyes glazed over' to me that means he's not really interested, I'd seek a second counsel.

          If you file bankruptcy and list this account, the notation on her report will read "Included in Bankruptcy". If you don't list this account or include it, then there won't be any effect on her report unless you start missing payments. And of course if you stop paying altogether, your mother will have to pay.
