    Car Payment Question

    My husband and I are filing BK on Sept. 8th. We have not made our car payment to Wells Fargo since June. So far, we have received limited calls. Do you think that they will try and sue us before we file? Again, the only contact we have had with them have been the limited phone calls, no written correspondence at all.

    How do you go about turning the vehicle in? Is that something that our lawyer will assist us with, or do we need to make arrangements w/ WF?

    They don't need to sue you to pop the car, just a demand letter for you to cure the deficiency. If you want to surrender the car now, either call them and let them know where it is, or send them a letter saying the same thing. Some people drop it off at a branch and throw the keys at a teller and run like heck!!(kidding) but you can drop it off at the bank and give the keys to someone there. If you do it after the BK, they will have to get relief from the BK 45 to 60 days, and then they will pop it.

      If they want the car they can come get it, since you haven't filed yet. If you want to turn it in now, just go drop it off or call to let them know.

      I stopped my payment on my SUV in March, filed in June, had 341 in July and the company filed for relief of stay in August. I called them the day after the deadline and they came to get it. My attorney didn't think they would file since they could have gotten it after discharge. We were both surprised since I had 3 weeks before last day of objections.

        We just surrendered a car to Wells Fargo (a year after discharge). I just dropped off the car at the local WF office, where we originally signed the paperwork. They made no fuss at all, just checked the inside to make sure we took all our belongings.

          We went to drop off the car today. My husband went to the local WF office and gave them the keys and title. He didn't give them a chance to question us, just told them to call our lawyer. Took all of 2 minutes. I am so glad that is over, now on to the filing!
