    OMG! Bank Paid ACH for Mortgage!

    I forgot to cancel the ACH for my mortgage payment! I got an overdraft statement today stating that the account was -$176 and then paid one over draft for $617 and then returned one for $617! On top of that they have assessed fee of $25 each for overdraft and then a $5/day daily overdraft fee.

    So, we were going to file on Friday! Is this going to throw a wrench in it?!?!

    I have been so preoccupied with things and working that I totally forgot to call!

    I don't really know what to do at all. And advice I would me more than greatful for!

    You need to call your bank and tell them you intended to stop that ACH and forgot to, because you knew you wouldn't have the money in the account. It is too late to stop the one that went through, but explain that you need help on the fees. Also, tell them when you will be able to deposit money for the overdraft.

      Forgot to say I don't think it will affect your BK petition.

        I really don't have the money to put into the account to pay for it! It's over draft $863.31!!

        I am really flipping out because I have just about that amount saved up to pay for my lawyer tomorrow so we can file!

        What should I do!!!

          Something similar happened to me so I threw myself on the "mercy" of the bank....They told us since we had had an account such a long time they would refund the fees, penalties, etc. which they did. Try that.

            Should I just let it be and claim that amount in BK7? I was hoping to file tomorrow....

            (We have already opened another account at the credit union)

              Any advice on wether I will be able to claim the total overdraft amount in BK?

              Would this still be considered a payment on to our mortgage company if the ACH went through?
