    Surrendering a car

    My husband and I surrendered our car today. We are filing for BK on 9/8. We are including it in the BK, but I am now worried after reading some posts that it will still be listed as a repo? Is this true?

    Also, we bought a new car in July knowing we were getting rid of the Trailblazer. We are planning on reaffirming the loan on this car. Is there anyway that they could take this car away from us? The loan is through Capital One Auto Finance.

    I doubt the car would show up as a repo with it being so close to your filing. The events are so close together, that it will probably just show up as Included in BK.

    With regards to the new car, if you're reaffirming, it's very unlikely Capital One will repossess the vehicle. Lenders are more interested in getting your monthly payments and not owning vehicles.
