    Is this cross-collateral (?) or BS!

    Long story short, we changed our minds after filing and surrendered our vehicle. The credit union went to court on the 20th and had the stay lifted (yep only 5 days from discharge). They took the vehicle on Monday the 25th.

    Well, I went online to check my accounts and I see that my checking and savings with them have been closed. No biggy, rarely used those accounts anyways. Total amount in them was $4.62. I see that on the 25th they took that money and applied it to the interest on the vehicle!!!

    Now I still have an equity loan that we will continue paying so in my mind I am thinking they took MY measely $4.62 and paid themselves money that they should NOT have. They could have applied it to our equity account.

    Hubby thinks we should just let it go but I on the other hand feel this is wrong. Its the principle. It feels like they stole it because they could. Whether legal or not.

    What do you think?

    Considering that you probably discharged a lot more than 4 bucks, I don't see a principle here.

      When I was looking over the loan agreements for our cars it stated that the cars/credit cards/other loans are cross-collaterized but that anything secured by a primary residence is not cross-collaterized. If your areements are the same way that is why the $4.62 was applied to the car and not the house.

        I"d just drop it, I do think probably cross collaterilisation, it would cost far more than 4 dollars to get it back, not really worth it.

          This has absolutely nothing to do with how much I discharged. This has to do with..why am I paying even one penny towards something that #1 - I no longer own..#2 - am no longer responsible for? This debt is no longer mine as it has officially been discharged in bankrupcty. We were current up until this month so technically they took an 'advance' on interest for next month even.

          So the principle is... if they take $4.62 from me how much are they taking from other BK filers that they should not be?

          If I went into a store and stole $4.62 worth of merchandise. I would be arrested and charged with petit larceny. Because they are a credit union they can take whatever they want? Makes no sense.

          This is just the icing though as this Credit Union has pulled quite a few cards throughout this process. We were going to continue our faithful payments on this vehicle till they tried to add $800+ in legal fees. They have also increased our monthly payment on our equity loan. No explanations just do whatever it is they feel like doing. Definately the last time I ever deal with a CU!

            You know MOMof5 I am with you. I am so sick of these banks /CU just doing as they place. I fight with them all the time. Go fight for your 4 bucks
            I keep thinking banks are building sky scrapers and people are losing their homes. They are thieves. I would fight with them over a nicely.

              I understand principle. Don't know if you are right or wrong but it doesn't really matter.

              For that amount, I would not work myself up. You risk your health by doing so.

              You should let it go IMO and go take a nice long bubble bath (or whatever else turns you on).

              Let em have their paltry sum. Keep your peace of mind.

                Oh man, I sure wish that was all I had to worry about.4 lousey bucks...Geez sorry but let it go and be happy its over..Geezie Louisie I agree go take a bubble bath and have a stiff drink...lol

                    Mag, statements like that just give rise to the opponents of BK to say that BK is organized crime.

                    Supporting an argument with inflammatory statements does not help the cause, any cause.
