    When you did your means test did you have zero disposal income leftover?

    I was wondering if you had to have zero in order to qualify. I hear different numbers from everyone. our attorney figured our disposable income to b $155. He said that was fine and that we wouldn't be forced into a Ch. 13.
    8/5/08 - Filed Chapter 7
    9/10/08 - 341 Meeting - It went great
    11/10/08 - Last day for Objections
    11/12/08 - Discharged & Closed!

    I was in the negatives. I was also over the median. I haven;t been discahrged yet but it's been 70 days so it should be soon.

      I would like to hear from people on this too. For those of you that got put into a CH13 what was your disposable income that made you switch?

        We were -300 on the means test and -55 on the Schedule J. I would not have that much disposable income going into a Ch. 7. Are you +155 on the means test or the Sch J? What is the figure at the bottom of your Sch J. That number is more important than the means test.

            My lawyer had me with less than 100 and more than 0 on the filing. If you have vehicles or home you are reaffirming you need to show slightly positive in order for it not to be considered an undue burden.
            May 31st, 2007: Petition Filed by my lawyer
            July 2nd, 2007: 341 Meeting Held
            September 4th, 2007: Discharged and Closed.

              No we weren't pushed into a 13. We had no disposable income after all of our expenses. We actually showed that we were short about $300 on the means and short $55 a month on our Sch J. We had more expenses than income on both parts.

              Theoretically, if you have more than $110 extra after your expenses every month you can be pushed into a 13 and if it is over $186 extra a month, it's almost guaranteed that you'll get pushed into a 13.

              There is a little more emphasis on your Sch J as they are your actual expenses whereas the means test uses a lot of standardized numbers.
