Probably. Because I am the one who had to pry open your passenger door for her to get out... and my hand was injured from my air bag. She had to crawl over the console to get out of the car... so obviously she wasn't hurting to bad. From the letter she seems to be chasing after "pain and suffering" and mental anguish or something.
Well he told that to us before the 341 meeting. The reason I am worried about it now is cause the bankruptcy guy brought it up as if it's not covered under it.

I don't think so. I don't think a judgement has been made on the thing yet. They do have a lawyer from the insurance representing me. Hopefully they still do, we had to cancel the insurance recently because our car can be repo at any time.

What does your car insurance representative say? The respective auto insurances are going to have to go at it with each other, is what I am thinking.
From what you said in your post, this person sounds like a 'fall-down-con-artist', only in automobile form.
If your BK attorney is telling you not to worry about it, please try not to. [FAR easier said than done; I know all too well.]

You should send the lawsuit paperwork to your insurance. They start off by sueing "you" and you just forward it to your insurance company and they take care of it.
