    Mortgage Company Filed for Relief of Stay-How long?

    Checked Pacer tonight and saw that our mortgage company filed for Relief of Stay. Court date is scheduled for 9/17. Does anyone know home much time we have in our home once the relief of stay is denied? Do we have to be out on 9/17? or do we have some time?

    A company called MRES filed on behalf of our mortgage company who is countrywide.

    It depends on state law. Are you in a judical or nonjudical foreclosure state? If it's the former, they have a lot of legal hoops to jump through.

      It's in the state of Hawaii. When I look up the foreclosure law it states that Hawaii is judicial and non judicial... thanks!
