    Boy did I have one crappy day today. I met with a new attorney, the one Dollar Bill

    referred me to. First off what a great man, really. What he told me wasnt what I wanted to hear thats for sure. Basically he thinks he can protect my Mexico property, but he also said the trustee can go after it and have no time frame to sell it.
    As far as my cc's, I have 3 biggies. One will be a year old in Oct. The other two are relatively new, about 5 months in Oct. and the other 5 months in Nov. I had planned on waiting alittle over 6 months before I would file and live in hell until then with calls and such. Now the attorney tells me that because the balances (all from Bal. trans. not from charging) are so large that I would get objections from all 3 for sure even at 6 months. I have NO money to pay them the min balances range from 232 to 400 a month each and thats with 0% interest that I still have until 9/8 when I wont beable to pay anymore.
    He preceded to tell me I would have to wait until next March or April to file and save up enough money to fight the objections which would cost about 8-9k for all three should that come up.
    He also said that because I fibbed on my income that would be a problem also.
    So now I have to wait and not answer my phone and start waiting for the CA's and laywers and judgements. I'm not very strong when it comes to this stuff and Im afraid I'll have a nervous breakdown. Either that or go the other way and screw it...I hope its the latter.
    Then I come home to find a letter from my health care provider saying starting Oct. my health insurance is going up from $620 a month to 720...I feel like Im getting hit from one side and then the other.

    Well better he tell you what you don't want to hear and be honest than lead you with a line I figure.

    If you start not paying in September. Then the phone will get busy but I don't any major problems for at least 6 months. Never heard of them going for a judgment before charge off which is 6 months. Then they'll send more letters and stuff, they are acting a bit faster but I don't think you need to worry about a judgment even if you waited 9 months to a year.

    To handle the calls get an answering machine at home. Make sure it clearly identifies you. Then let it pick up all calls. Turn ringer off. Check it once or twice a day and call back friends/relatives. Maybe once a month return 1 call to each creditor, tell them you have no money at this time, that you are working on trying to fix the problem. Whatever you do don't tell them you'll send any money. Should keep them busy for 9 months.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      would take my money and then I'd get an objection and then they would want a bunch more to fight it for me
      This attorney said to try and pay them something and call them and tell them Im trying to pay, but not to say anything about BK. Just try to stall them. Problem is work is sooo bad Im having a tough time paying rent, utilities, and insurance...I just may let my insur. go. But if I did that I would not beable to ever get insur until medicare kicks in and thats not for another6.5years. Alot can happen to someones health in that time frame. I hate the insurance co's

        Your attorney gave good advice.

        One thing some folks do is to prioritize bills.

        Food
        Home
        Utilities
        Car
        Gas
        Insurance
        Taxes
        Etc
        way down at the bottom credit cards.

        They then fill out a monthy budget showing were all the money is going. They then take whatever is remaining after the expeditures and divide evenly among all creditors.

        Say you got 100 bucks left at end of month. 5 Creditors each get 20 dollars. Now this is less than minimums but most will still take it. Folks just show how this is divided up and then mail copies to each of the creditors.

        Try to keep your insurance, as if something happens you might need it.

          if they were balance transfers why does the 6 month timeframe not work?

            The attorney said because they are large balance transfers. One is 18k and the other two are both Citi cards which total 47k...bummer aye?

                Wow what a horror story, I hope your doing alright.
                Can I ask how long did you have your debt before your bk? My problem is one is almost a year old but the other 2 biggies are only 5 months...
                I wish you such better times ahead makes me so sad to hear eveyones story. At least you have each other thats a blessing.

                  Well that's another worry on my pile.. my last balance transfer check was $19,500 and it was in February on BofA.. so they may still object even if I file end of Sept -- and been paying more than minimum payments??? shheeesh.

                    Gosh Froggie, I dont have a clue...thats 7 months and your

                    paying more than the monthly? I wish I had that under my belt. I'm going to make some calls tomorrow to Citi and B of A and just see what they can do to lower my min's. The only thing is how can they go lower than 0% interest? BofA is 1.99%. I dont have an extra 1k a month to pay even the mins....Keep me posted on what you decide to do ok?

                      DW had some CCs that were 5 and 6 years old she has not paid. The only one that get very ugly was discover card they sued her and got a judgment.
                      It takes time for all of that to get going.

                        It usually takes time but doesn't necessarily have to.

                        HSBC farmed my account out to an outside collection agency within 4 months. They called relatives and I sent a cease and desist letter. Next thing I knew it was in the hands of an attorney who wouldn't even talk to me because of the cease and desist.

                        Of note: I had asked both the CA and the attorney by certified letter for debt validation and never got it.

                        HBSC is the only one who tried and got a judgment against me. All I am saying is never say never...you roll the dice with any of your actions.
