My bk attorney recently amended our schedules for her fees. I've read a few posts as to doing so for new debts. We were discharged in 1/08 but our Chapter 7 case is not closed yet. We have one more buy back payment to our trustee (3000. total). I have outstanding medical bills dated from the time of our filing in 10/07 till discharge in 1/08 till now. Can any of these bills be added? Also how can my attorney amend my schedules for her fees without my consent? She's done this 3 times.

When you retained your attorney, you hired her to look our for what she thinks may be in your best interest. If she has not discussed the amendments with you--shame on her, unless she is correcting clerical mistakes and such. The medical bills should have been included--if they existed PRIOR to your filing date. You cannot add any new ones.
I don't know about the addition of the attorney fees. It is a one-time feee of $26.00 to amend, so once the first amendment was done, they were all covered.
At least that is the way I understand it.
We are also an asset 7 case and are buying our stuff back from the bK estate. We have been discharged, but the case won't be closed until after we make all the payments. We also discussed amending our schedules prior to the discharge, but our attorney said that she had discussed the matter with the trustee, and that he wasn't concerned about it.
